2. Product Listings, Availability & Pricing
• We make every effort to display accurate descriptions, dimensional measurements, payload capacities, and pricing. • All listings and pricing are subject to change without prior notice based on regional inventory availability and steel market fluctuations. • In the event of an inadvertent typographical error, inaccurate technical specification, or pricing error, Global Containers Sales USA reserves the right to correct the error and revise or cancel affected orders prior to delivery, issuing a prompt full refund if payment was already received.
3. Order Acceptance & Binding Contract
The receipt of an automated electronic order confirmation does not signify our final acceptance of your order. Global Containers Sales USA reserves the right to accept, decline, or limit order quantities based on equipment inventory, geographic logistics feasibility, or security verification checks. A binding agreement is finalized upon dispatch scheduling and invoice clearance.
4. Risk of Loss, Title & Delivery Site Obligations
• Title and risk of loss pass to the customer upon physical carrier delivery and completion of offloading at the designated destination. • The customer is solely responsible for ensuring the delivery site is safe, legal, accessible, and compliant with all local municipal zoning ordinances, permits, and property regulations. • Any redelivery, standby, or towing charges incurred due to customer site inaccessibility, soft ground, or low overhead obstructions shall be the customer's sole responsibility.
5. Disclaimer of Warranties & Limitation of Liability
• Except for express manufacturer warranties provided in writing for new equipment, products are supplied on an 'as-available' basis. • To the maximum extent permitted by applicable law, Global Containers Sales USA and its officers, directors, employees, and logistics partners disclaim all indirect, incidental, special, punitive, or consequential damages (including lost profits, lost business opportunities, equipment downtime, or cargo loss) arising out of the purchase, delivery, use, or delay of any equipment. • In all circumstances, our maximum aggregate liability to you shall not exceed the actual gross purchase price paid for the specific product giving rise to the claim.
6. Governing Law & Jurisdiction
These Terms & Conditions, and any dispute arising out of or related to your purchase or use of the website, shall be governed by, construed, and enforced in accordance with the laws of the State of California, United States, without regard to conflict of law principles. Any legal action or proceeding arising out of these terms shall be instituted exclusively in the state or federal courts located in Los Angeles County, California.
